End User License Agreement

By clicking on "I Agree" below, the Data User, certifies that he/she will use any counts or data made accessible to him/her by L2, Inc. through the QuickCount system, in conformance with all federal, state and local laws whether statutory, regulatory or common law governing use of voter file or consumer data in the state or states from which those data are drawn. The Data User represents and warrants that he/she has informed himself/herself of all such applicable laws and will use the data provided only in conformity therewith. The Data User further acknowledges his/her awareness of special rules for the use of cell phone numbers as governed by the Telephone Consumer Protection Act promulgated by the Federal Communications Commission. Data User represents and warrants that no data provided by L2 through the QuickCount system will be used for immoral or illegal purposes or for assessing credit worthiness, employment opportunities or insurance claims. Data User represents and warrants that the data provided by L2 through the QuickCount system will not be used for the purposes of jury consulting or analysis without the prior written consent of L2.  L2, Inc. provides no warranty, express or implied, as to the accuracy, reliability, utility or completeness of such information including any count totals generated by the QuickCount system. All counts and any data through use of the QuickCount system are provided on an "AS IS" basis. All warranties of any kind, express or implied, including but not limited to the IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, freedom from contamination by computer viruses and non- infringement of proprietary rights ARE DISCLAIMED. Data User should be aware that demographic data and counts can quickly become out-of-date. Data User assumes all responsibility and risk for his/her use of the data and counts provided through the QuickCount system. The Data User shall defend, indemnify, and hold harmless, L2, Inc. and its affiliates and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys' fees and court costs, arising out of any use by Data User of the data or counts supplied herein.  The data ordered through the QuickCount system is the exclusive property of L2. Data User has been granted a limited non-exclusive license to utilize such data for the allowable purposes.  Data User further certifies that he/she has engaged in no deceptive practices in gaining access to or utilizing this site.  Deceptive practices include, but are not limited to, a) the creation and use of a false identity when requesting data through this site, b) any attempt to reverse-engineer functionality of the site for the purpose of bypassing normal functionality or c) any actions taken to thwart the existing functionality of this site.  Data provided through QuickCount is a trade secret consisting of a unique compilation of data elements and is subject to copyright protection.
